On Oct. 18 the Senate judiciary committee reported without recommendation a bill reinstating the death penalty for more than 20 federal crimes including espionage, the attempted assassination of a President, and the murder of federal officials.

(Occasionally, a committee will report a measure "unfavorably," with explicit recommendations against its passage, or it will report a bill "without recommendation," which has the same effect as an unfavorable report.)

Then, a motion to report the bill "without recommendation" failed by the same margin, 10-8.

(E) Special Voting Provision.-If a tie vote occurs in a Subcommittee on the question of forwarding any measure to the Full Committee, the measure shall be placed on the agenda for Full Committee consideration as if it had been ordered reported by the Subcommittee without recommendation.
