Chief Gates recently testified at a trial involving the beating and hogtying of a man by the police.

LEAD: Hogtying is regularly practiced on farms, ranches and in slaughterhouses to weigh, butcher and otherwise restrain four-legged creatures.

For his part, Mr. Caruso has heatedly criticized an order by Mr. Ward on Feb. 17 banning the hogtying of prisoners.

Mr. Ward said that he did not believe that the hogtying of the prisoner, a 35-year-old subway track worker who was arrested early last Thursday for attempted burglary after a violent struggle with officers, had contributed to his death.

While saying that he did not believe the hogtying had contributed to the death - cocaine was found in the suspect's blood - Mr. Ward added that it was "not a proper way for a professional police agency to handle a prisoner."
