European Convention on Extradition

The European Convention on Extradition took effect, providing uniform rules for all member nations.

Under the European Convention on Extradition, Spain does not have to offer any evidence to support the charges.

The European Convention on Extradition does not require Spain to produce evidence of its charges.

Britain suggested that all members should sign the European convention on extradition, and that each nation's legislation should be adapted accordingly.

I congratulate the presidency of the Council on that result, specifically on the European Convention on Extradition, which will make it possible to fight terrorism effectively.

The principal instrument which governs extradition arrangements between European Union Member States is the 1957 European Convention on Extradition.

The European Convention on Extradition is a multilateral extradition treaty drawn in 1957 up by the member states of the Council of Europe and in force between all of them.

Mr. Straw said the remaining allegations of torture and conspiracy to torture satisfied the European Convention on Extradition and imposed an obligation on Britain to permit the Spanish request to go before British courts.

Territories designated under part 2 are non-EU members of the European Convention on Extradition; or the London Scheme for Extradition within the Commonwealth; or else they are parties to bilateral extradition treaties with the UK.

Some examples include the European Convention on Extradition, the European Convention on the service of judicial and extrajudicial documents in civil or commercial matters and the Protocol to the Convention on the protection of the Communities' financial interests.

Measures which sought to harmonising extradition rules across EU member states go back to the mid-1990s when the EU institutes two treaties under the Maastricht Treaty which sought to streamline existing extradition procedures under the European Convention on Extradition.
